A Chicago woman, Marimar Martinez, shot by a Border Patrol agent during a confrontation in Brighton Park on Saturday has been charged with assaulting federal officers. Prosecutors have also charged a man who allegedly rammed federal vehicles during the same altercation.

A senior Department of Homeland Security official said on Saturday the woman, Marimar Martinez, 30, was armed with a semi-automatic weapon when she rammed a federal vehicle and later accelerated toward an agent.

According to the complaint, agents were working in Oak Lawn on Saturday morning when a convoy of vehicles, including a Nissan Rogue driven by Martinez and a black GMC Envoy driven by 21-year-old Anthony Ian Santos Ruiz, began to follow them aggressively.

One of the federal vehicles, occupied by three Border Patrol agents, broke away from the others to serve as a diversion, drawing Martinez and Ruiz away from the other agents, the complaint said.

The vehicles made their way into the city with drivers running red lights, going the wrong way on one-way streets, and yelling “la migra” at the agents, according to the complaint. At 39th Street and Kedzie Avenue, prosecutors say, Martinez sideswiped the agents’ Tahoe, while Ruiz struck its rear passenger side.

When the agents stopped and exited their SUV, Martinez allegedly accelerated toward one of them, prompting the agent to fire about five shots. Martinez fled north but was later found at a repair shop near 35th Street and California Avenue, where paramedics took her to a hospital for treatment of gunshot wounds. Federal officials said she was discharged to their custody on Saturday evening.

Ruiz parked at a nearby gas station and was arrested at the scene.

Photos attached to the complaint show damage to both the Border Patrol SUV and the civilian vehicles consistent with the collisions. Body-worn camera video from at least one agent also captured part of the confrontation.

Martinez and Ruiz are charged with forcibly assaulting federal officers with a dangerous weapon in violation of federal law.
