The docs, obtained by TMZ, show Songz's suit was thrown out Monday after Trey's legal team successfully argued the statute of limitations expired long before the woman -- who filed anonymously as a Jane Doe -- filed her complaint.
The statute of limitations in CA is currently 10 years -- but that wasn't made official until 2019 -- prior to that it was 3 years ... but the woman filed 6 years after the alleged rape.
The woman claims the singer overpowered and anally raped her despite her begging him to stop. She was suing TS to the tune of $20 million in damages.
However, on Monday (October 31), the entire case was dismissed after legal documents showed that the statute of limitations ran out on the allegations. According to TMZ, Trey’s legal team successfully argued the statute of limitations expired long before the woman filed her complaint.
Jane Doe filed her suit against the “Can’t Help But Wait” singer six years after the alleged sexual assault. Although the statute of limitations in California is currently 10 years, that wasn’t made official until 2019. Prior to that, there was a 3 year limitations law.
In July, Jane’s lawyer George Vrabeck, asked the court to dismiss the case, only to refile lawsuit with an additional claim of negligence two days later. Jane Doe’s case wasn’t the only charge brought up against Trey Songz in recent years. Back in April, a woman demanded a $5 million settlement from the father of one, after he allegedly groped her at a party.
Former college basketball player Dylan Gonzalez also accused Trey of raping her back in 2013. However, police decided not to pursue charges unless new evidence emerges. In 2018, the Ready singer turned himself in to police after being accused of striking a woman at Hollywood Hills party during NBA All-Star Weekend.
Per TMZ, the statute of limitations on the allegations has expired, causing the legal system to discard of the civil suit.
A woman under the alias of Jane Doe filed the complaint earlier this year claiming she initially had a “consensual” relationship with the R&B singer but claimed that Trey Songz became a “savage rapist” in March 2016. She alleged that TS anally raped her when she told him repeatedly to stop and was seeking $20 million in damages.
Trey’s legal team intercepted the filing and had the civil suit thrown out since the statute of limitations in California only lasts two years — so anything after March 2018 wouldn’t find Trey Songz liable.
This is far from the only sexual assault-related lawsuit Trey Songz has faced in recent years. In April, Trey Songz was cleared of the sexual assault allegations stemming from an incident in a Las Vegas hotel last November.
